2. Privacy

This Privacy Policy outlines the purposes for which personal data is collected and how we strive to ensure adequate protection of this data.

We comply with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC, hereinafter referred to as the “GDPR.”

Furthermore, we will ensure, to the extent possible, compliance with the implementing decisions taken pursuant to the aforementioned legislation.

2.1. Personal Data

Personal data includes all information relating to an identified or identifiable person. A person is considered “identifiable” if they can be identified, directly or indirectly, in particular by reference to an identification number or one or more specific elements characteristic of their physical, physiological, psychological, economic, cultural, or social identity.

As the data controller, we may collect, for example, your name, address, telephone number, email address, IP address, and similar data.

2.2. Data Management

We ensure proper security of stored and processed personal data. Both we and our appointees take the necessary technical and organizational measures to secure the processing activities.

To the extent possible and reasonable, we will ensure that data is updated and that incorrect, incomplete, or irrelevant data is corrected or deleted.

Furthermore, to the extent possible and reasonable, we will ensure that our appointees have limited access to the data and processing capabilities, restricted to those persons who need them to perform their tasks or as necessary for the service’s requirements.

In this way, we aim to provide an appropriate level of security for this personal data and its processing.

The data subject is required to provide the requested personal data, as this is a necessary condition for entering into and performing the agreement. If the data subject does not provide the requested data, we will be unable to deliver the requested products and/or services.

To enable targeted direct marketing, we use profiling. This allows us to inform our customers via email only about promotions and products in which they may have a particular interest.

2.3. Purpose of Processing

We process personal data for various purposes. For each processing activity, only the data necessary to achieve the intended purpose is processed.

Specifically, we pursue the following objectives:

  • Customer administration and order processing;
  • Execution of agreements;
  • Invoicing;
  • Direct marketing and statistical purposes;
  • Optimizing the quality, content, and management of the website;
  • Responding to specific inquiries and/or providing information via our contact form.

2.4. Legal Basis for Processing

The processing of personal data is carried out based on the following legal grounds:

  • Consent of the customer/data subject;
  • Necessity for the performance of the agreement or taking pre-contractual measures;
  • Necessity for pursuing our legitimate interests, particularly ensuring the continuity of operations;
  • Compliance with all legal or regulatory provisions to which we are subject.

2.5. Sharing and Transfer of Data

In principle, personal data is only shared with the consent of the relevant individual or when necessary to complete a transaction or provide a product or service.

When making purchases via the webshop, data is shared with the payment provider.

Furthermore, data may be shared with our suppliers when legally required, when we are involved in a dispute with the data subject, to protect customers, to ensure product safety, or to safeguard our (property) rights.

We will not transfer the relevant data to a third country or international organization.

2.6. Data Retention Period

The collected personal data will be processed by us for the entire period during which the data subject uses our services.

When the data subject no longer uses our services, their personal data will be retained for a period of ten years following the end of the collaboration, unless certain legal limitation or retention periods require a longer duration.

This period allows us to comply with legal obligations, enforce regulations, resolve disputes, maintain security, and prevent fraud or abuse.

2.7. Rights of Data Subjects

We will facilitate the exercise of the following rights for the individual:

  • Right to access their personal data;
  • Right to rectification of inaccurate personal data;
  • Right to erasure of personal data;
  • Right to restriction of processing of personal data;
  • Right to data portability;
  • Right to object to automated individual decision-making.

Moreover, the data subject has the right at any time to withdraw consent given for the processing of their personal data. Such withdrawal does not affect the lawfulness of processing based on consent prior to its withdrawal.

To exercise these rights, the data subject may submit a request via email to info@wernutrition.com.

We will respond promptly and, in any case, within one month of receiving the customer’s request.

2.8. Final Provisions

If the data subject believes that the processing of their personal data constitutes a breach of GDPR provisions, they may file a complaint with the competent supervisory authority.

We expressly reserve the right to modify this Privacy Policy at any time without prior notice.
